AZULWEAR - TERMS & CONDITIONS
USE OF SITE
Azulwear CC is an online shop and we do not physically hold stock of all the products listed on our website. We can't guarantee that the product you order will be in stock at the Azulwear CC depot or with our suppliers at time of order. Please feel free to contact us to enquire on stock availability prior to placing your order.Lead time is dependent on stock availability. Should stock be available at the Azulwear CC depot, Azulwear CC will endeavor to dispatch your order within 7 days provided payment reflects in the Azulwear CC bank account as specified on the order confirmation. Should the product not be in stock at the Azulwear CC depot but in stock with our suppliers, please allow at least 7 to 10 working days plus freight transit time. Every effort is made to effect shipment of your order timeously however unforeseen circumstances may cause delays. Should we be faced with such an occurrence Azulwear CC will endeavor to contact you and provide a revised shipping schedule. We cannot be held to a specific date or time and we shall not be held liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery. We will endeavor to advise you of any delays relating to your order. Azulwear CC reserves the right to cancel your order even if payment has been made should the product not be in stock with Azulwear CC or our suppliers. Should Azulwear CC cancel your order we will offer you a choice of either placing the product(s) on back order (price is subject to change and exchange rate fluctuations), a credit on your account or an immediate refund in full. In the case of an immediate refund on an EFT payment, funds may only reflect in your account a day or two following the actual refund - this is beyond our control. All risk in the Product shall pass to you upon dispatch for delivery, from the time when risk passes to you, we will not be liable for loss or destruction of the product. If you are not available to take delivery, we may leave a note giving you instructions on either re-delivery or collection from the courier company concerned. Please note that we may be unable to facilitate delivery to certain addresses. In the rare event that this is the case, we will advise you and arrange for cancellation of the order or delivery to an alternative delivery address.Where you agree to have your products placed on back order you are hereby informed that the date the goods are expected to arrive are subject to change due to circumstances beyond our control as well as the price being subject to change due to circumstances beyond our control and subject to exchange rate fluctuations which are beyond our control. Should the price change, Azulwear CC will inform you and you will have the choice to either pay in the difference or elect a credit on your account or an immediate refund in full.
Please ensure the correct shipping address is provided from the outset as title and risk will pass to you once the order has left our premises. Any person other than yourself who receives the products at the delivery address is presumed to be authorised to accept delivery on your behalf.Please arrange that you or your authorised representative is available to accept your purchases at the delivery address to avoid additional delivery charges. We cannot specify a time of day for delivery. Delivery will take place during the course of the business day unless the incorrect delivery address has been supplied or no one is able to sign for the order in which case the order will be returned to their depot and re-scheduled for the delivery the following day, should orders be returned to us, and we having to resend order, then this will incur an additional delivery charge. Orders that are not delivered in the Western Cape - a tracking number will be provided from selected courier or postal service. On delivery, we will require you or your authorised representative to sign and print your or their name on a duplicate copy of the delivery note, to confirm receipt. We have outsourced all delivery and collection arrangements. Accordingly, we cannot, be liable for any damage suffered or loss incurred by reason of any acts or omissions of the deliverer, its directors, employees, sub-contractors, agents, representatives and/or affiliates.Please note some of our couriers do not deliver to certain areas, in this case your parcel will be sent via postal service, where we will send you the tracking number to follow up on your order.
SHIPPING Delivery Outside of South Africa
Azulwear CC are registered importers and exporters and are able to deliver / export products to destinations outside of South Africa. Due to complexity when calculating international shipping costs, we are unable to process online transactions where delivery outside of South Africa is required. Should you require delivery outside of South Africa please contact firstname.lastname@example.org providing product list and their quantities including physical address to where you require delivery. We will quote you accordingly.
REFUNDS / RETURN POLICY
Any acceptance of returned products are at the sole and absolute discretion of Azulwear, and subject to the following conditions: Should you for any reason wish to cancel your purchase you will be liable for a 35% handling fee. You must advise us in writing of your cancellation or exchange and any such cancellation must be signed by the person who made the original purchase. The goods must be returned to us undamaged in the original packaging within 7 calendar days.
No claims will be recognised and/or accepted if made later than 7 days after receipt of the goods in writing
Azulwear will under no circumstances accept branded goods, nor be responsible for the quality and correctness of the artwork
Goods will not be deemed refundable if instructions have not been followed
No returns will be accepted on imported and custom manufactured items.
Please note we do not accept returns on bulk orders above R2000.00. All returns on unbranded stock will be subject to a 35% handling fee
All costs resulting from transport of returned goods will be for the account of the customer
* Note: Azulwear CC recommends that you use Couriers for all returns as it offers shipment tracking through a 24 hours customer helpline. Should you choose to use a carrier that does not offer a tracking facility and the goods are lost then no refund or return will be considered.
Unfortunately Azulwear CC do not hold stock of all samples. Samples may be purchased to asses their sutability, design, quality and specifications - as per normal orders stated above and may be returned for credit or refund within the 7 day return policy. Maximum amount that may be purchased as samples is R2000.00.
APPROVAL FORM AND DELIVERY NOTES
Artwork approval forms and delivery notes form part of this Terms and Conditions and is in no way severable from the remainder of the clauses of this Terms and Conditions.
No cancellation of orders will be accepted from customers on account once final approval of artwork has been received.
The customer is to ensure that proof of payment has been received by its account consultant. Azulwear can not take responsibility for missed deadlines if payment has not been confirmed with the account consultants.
Delivery dates are quoted from the day after artwork approval and receipt of payment, whichever date is the latest
Amendments made to artwork approvals will result in the delay of the delivery date. Should the customer require amendments Azulwear CC will issue a new layout for final approval before production commences. (Amendments to layout can take up to one day to generate.) Artwork done by Azulwear CC will be charged at an hourly fee of R350.00.
Subject to the customer abiding and complying with the terms of this agreement, goods are sold subject to a limited six month warranty by our suppliers against defects in workmanship and materials, as the result of normal use. Azulwear CC offers no warranty and shall bear no liability in respect of any defect or damage arising from fair wear and tear, damage, negligence, abnormal working conditions, misuse or alteration of the goods, or unintended or unreasonable use. Azulwear CC offers no warranty and is not liable for any damage arising from rips, tears, abrasion, UV degradation, misuse or neglect, it being recorded that fabrics deteriorate and fade over time and moving parts wear out, and that goods may suffer from differing degrees of wear-and-tear, depending upon the user. Warranty claims shall be notified by the customer to Azulwear CC within seven business days from the date of delivery. Azulwear CC may elect to replace or repair the goods free of charge or refund the purchase price of the returned warranted goods, where after Azulwear CC shall have no further liability to customer. Save as expressly provided herein, Azulwear CC makes no warranties and there are no conditions of this agreement that the goods are fit for their purpose or of merchant.

PAYMENT OPTION AND PRICING
All transactions will be processed in South African Rands (ZAR)Azulwear CC endeavors to offer you competitive prices on current products; you're total order price will include the price of the purchase plus any applicable sales tax and shipping charges (on the day of shipping).Azulwear CC reserves the right to change pricing at any time without prior notice. Should Azulwear CC reduce its price on any shipped products within 10 working days of shipment, you may contact us and request a refund of the difference between the price you were charged and the reduced selling price. To receive the refund you must contact us within 14 days of shipment.
We accept MasterCard and Visa credit cards. If you do not have a credit card please utilise one of the other payment options, or simply log off and return to the site at a later time to complete your order. All of your order details will be saved online under in the Your Account section available for use whenever you’re ready! Sorry for the inconvenience.
EFT (Electronic Fund Transfer)
One of the most widely used ways of sending money online. Once you have added enough items to your shopping cart, proceed to “Checkout” and follow the order processing instructions. Select the option to pay via EFT. You will then have to load Azulwear CC as a beneficiary on your internet banking and use the unique order number in the reference line for your payment. This should ensure speedy processing and delivery of your selected products.

You may pay for your products through a direct deposit. It’s exactly the same as doing an EFT payment, except you’ll have to go into your bank and physically make your direct deposit there.
